Missed the SB 721 balcony deadline? Get compliant before it gets expensive.
The first inspection deadline for most California apartment buildings has passed, and an uninspected building is out of compliance with state housing law. Newer buildings run on their own date: if the building permit application was submitted on or after January 1, 2019, the first inspection is due six years after the certificate of occupancy instead, which can fall either side of that deadline. Once an inspection finds repairs, a $100 to $500 a day civil penalty can follow repairs that stay unaddressed. Non-compliance carries real exposure
Once you are past the deadline, the exposure is real. The fastest way to protect the building and your budget is to get inspected and get a documented repair plan moving before any of it starts.
Who has to comply with SB 721
SB 721 is California's exterior elevated element inspection law for qualifying multifamily buildings with three or more dwelling units. If your property meets the criteria below, an inspection was required and any repairs it finds follow on the clocks the statute sets.
Your building qualifies if it has
- Three or more dwelling units
- Balconies, decks, porches, stairways or walkways
- Elements more than six feet above the ground
- Wood or wood-based structural support
- Associated waterproofing systems
What SB 721 requires
- Inspection of at least 15% of each element type
- A report from a qualified, licensed inspector
- Repairs of any identified unsafe conditions
- A repair permit applied for within 120 days of receiving the report, for non-emergency work; emergencies are addressed immediately
- Re-inspection by January 1 every six years thereafter, so the next statewide date is January 1, 2032
